# TERMS & CONDITIONS

1. Interpretation & Definitions

In these Terms & Conditions, the following definitions apply unless the context otherwise requires:

* **Client** refers to any individual, organisation, business, or entity engaging Antonia Claire Photography for photographic services or products.

* **Photographer**, **I**, **Me**, **My**, or **Business** refers to Antonia Claire Photography, operated as a sole trader.

* **Images / Photographs** means all photographic material created by Antonia Claire Photography, whether digital or physical, including edited and unedited files.

* **Service** refers to all photography-related services provided, including website access, online galleries, and image delivery.

* **Standard Retouching** includes basic colour correction, exposure adjustment, minor skin blemish removal, and light flyaway hair correction.

* **Advanced Retouching** includes complex edits such as object removal, background manipulation, clothing alterations, or composite imagery and may incur additional fees.

2. Image Storage & Galleries

Antonia Claire Photography does not offer long-term image storage. Online galleries are available for **two (2) weeks** from the date the gallery is published. Clients are responsible for downloading and backing up their purchased images within this period. Reopening galleries may incur an administrative fee.

3. Client Information & Privacy

Client information is collected for booking, communication, and business-related purposes. This may include names, email addresses, phone numbers, and addresses. Clients may request removal from marketing communications at any time.

Confidential information shared by the Client will be kept private unless disclosure is required by law. For full details, please refer to the Antonia Claire Photography Privacy Policy.

4. Turnaround Times

Approximate delivery timelines are as follows:

* **Kinder & childcare photography:** up to 3 weeks after the photography date

* **Fundraising & general events:** within 24–48 hours

* **Private sessions (family, maternity, newborn, branding, headshots):** up to 3 weeks unless otherwise agreed

* **Weddings:** sneak peek highlights within 24 hours, full gallery within the agreed timeframe

Rush delivery may be available for an additional fee.

5. Editing Style & Creative Control

All images are edited in Antonia Claire Photography’s signature style. By booking, the Client acknowledges and accepts this creative approach. Unedited RAW files are not supplied.

Additional retouching beyond standard editing is available at an extra cost.

6. Creative Licence & Session Coverage

While reasonable efforts are made to capture requested images, specific shots or outcomes cannot be guaranteed due to variables such as subject cooperation, lighting, weather, or time constraints.

Antonia Claire Photography is not liable for image loss due to unforeseen technical failure, though all reasonable precautions are taken.

7. Copyright & Image Usage

All images remain the copyright of **Antonia Claire Photography**.

Clients receive a personal-use licence to print, share, and display purchased images. Images may not be altered, sold, or used commercially without written permission.

Images will only be used for promotional purposes with client consent.

8. Fees, Invoices & Payments

* All prices are based on the agreed scope of work.

* Payment is due within **28 days** of invoice issue unless otherwise stated.

* Late payments may incur a **5% surcharge per 28-day period**.

* Image usage rights are suspended until full payment is received.

9. Cancellations & Refunds

General Policy

Digital images and completed sessions are non-refundable.

Private Sessions

* Cancellations within 24 hours of the session may forfeit the booking fee and incur up to 50% of the remaining balance.

* Booking fees may be transferred once to a rescheduled date at my discretion.

Kinder & Childcare Photography

* Booking fees are non-refundable except in cases of child illness.

* Centre-wide cancellations are subject to notice periods and may affect refund eligibility.

COVID-19 or other sickness

If cancellation is required due to government restrictions or illness, clients may choose between a refund or rescheduling within 12 months.

10. Consent

Educational organisations are responsible for obtaining parental/guardian consent for photography. By purchasing images, parents/guardians confirm consent for their child to be photographed and included in galleries.

11. Limitation of Liability

Antonia Claire Photography’s liability is limited to the amount paid for services. I am not responsible for indirect loss, consequential damages, or third-party reproduction issues.

12. Governing Law

These Terms & Conditions are governed by the laws of **Victoria, Australia**, and any disputes will be subject to the exclusive jurisdiction of Australian courts.

13. Updates to Terms

These Terms & Conditions may be updated from time to time. Clients are encouraged to review them periodically. Continued use of services constitutes acceptance of any updates.

14. Weather & Environmental Conditions

For the safety of children, clients, and the Photographer, Antonia Claire Photography is unable to work in outdoor or non–climate-controlled environments when:

The forecast or actual temperature reaches 35°C or above, or

Weather conditions exceed light showers, including heavy rain, storms, high winds, or unsafe ground conditions.

If weather conditions are deemed unsafe or unsuitable at my discretion, the session or event may be paused, rescheduled, relocated, or cancelled. In such cases, clients will be offered the option to reschedule or receive a refund of any fees paid, excluding non-refundable booking fees where applicable. Antonia Claire Photography is not liable for incomplete coverage or missed images due to weather-related interruptions.
